Online-Plattformen prägen die Ökonomie zu Beginn des 21. Jahrhundert ebenso wie den öffentlichen Diskurs. Sie ermöglichen eine intensivierte Vernetzung ihrer Nutzer (Bsp.: Facebook, Instagram, TikTok und X) ebenso wie die Aggregation von Angebot und Nachfrage nach bestimmten Leistungen und Gütern (Bsp.: Amazon, Lieferando und Uber). Mit Blick auf Online-Plattformen stellen sich mannigfaltige Fragen, die von der Aufrechterhaltung des Wettbewerbs auf Märkten, die von starken Skalen- und Lock-in-Effekten geprägt sind, über die Verhinderung von Desinformation bis hin zum Schutz von Heranwachsenden reichen. Die Vorlesung mit integrierter Übung führt in die (noch recht junge) Regulierung von Online-Plattformen ein. Sie behandelt systematisch die wesentlichen rechtlichen Vorgaben, die für die Tätigkeit dieser Plattformen von Relevanz sind: insbesondere den Digital Services Act (DSA) und den Digital Markets Act (DMA). Daneben wird auch der Frage nachgegangen, inwieweit das „klassische" Wettbewerbsrecht in der Lage ist, Wettbewerbsbeschränkungen durch Online-Plattformen entgegenzuwirken. Online platforms are shaping the economy at the beginning of the 21st century as well as public discourse. They enable intensified networking among their users (e.g., Facebook, Instagram, TikTok, and X) as well as the aggregation of supply and demand for certain services and goods (e.g., Amazon, Lieferando, and Uber). Online platforms raise a wide range of questions, ranging from maintaining competition in markets characterised by strong economies of scale and lock-in effects to preventing disinformation and protecting minors. The lecture with integrated exercises introduces the (still relatively new) regulation of online platforms. It systematically covers the key legal requirements that are relevant to the activities of these platforms, in particular the Digital Services Act (DSA) and the Digital Markets Act (DMA). It also examines the extent to which ‘classical’ competition law is capable of counteracting restrictions on competition caused by online platforms.
